THE ROLE

The Legal Counsel - Claims is responsible for leading the handling of cargo claims and related incidents, with a strong focus on loss prevention, legal risk mitigation, and recovery from liable third parties. The role also includes providing legal support to MSC Agencies and ensuring adherence to company procedures.

YOUR IMPACT

As Legal Counsel - Claims you will:


In respect of the handling of claims and incidents:

  • Liaise with MSC agents and the other MSC HQ departments (operations, planning, chartering, documentation, liners, Medlog, etc…) with a view to organise the handling of incidents and claims to limit our financial, operational and legal exposure.
  • Identify in each country suitable experts and lawyers.
  • Retain, appoint and coordinate surveys and legal actions.
  • Investigate cargo and non-cargo-related incidents/casualties to assess liabilities and extent of damage (ex: injuries, damage to vessel, quay, rail accidents, etc…).
  • Receive and analyse claims submissions and notices of claims.
  • Identify liable third parties and organise recovery actions.
  • Manage autonomously all insurance-covered litigation (whether above or below policy deductible) with a view to mitigate losses, maximise recoveries and save costs.
  • Negotiate claim settlements with customers, terminals, vessel owners,..


In respect of insurance:


  • Liaise with insurers and their local correspondents.
  • Ensure appropriate insurance cover is granted under relevant policies.
  • Lead yearly claims review with insurers and Department’s management.


In respect of network management and loss prevention:

  • Ensure implementation and compliance with MSC HQ Legal and company procedures.
  • Identify cause of losses and identify possible patterns to offer loss-prevention solutions to re-occurring issues.
  • Provide legal assistance and proactive advice to the MSC network based on international conventions, local legislations and company policies.
  • Ensure proper file recording and keep the claims management system updated.
  • Proactively participate to the department’s activity by sharing information and crafting more efficient processes.
  • Ensure the training of MSC agents on legal procedures, claims handling, claims management system, MSC tools, etc..
  • Report to the direct management and/or Department’s Head.
  • Understand local dynamics between external factors (macroeconomics, political trends, industry trends) and internal functions (internal processes, departmental knowledge etc.) and apply them to their day-to-day responsibilities.


YOUR BACKGROUND

  • Master’s degree in law; specialization in maritime law or marine insurance is a plus.
  • Strong knowledge of the shipping industry and legal frameworks.
  • Excellent command of English (spoken and written); French is an asset.
  • Proficiency in Microsoft Office, especially Excel.
  • High sense of responsibility, autonomy, and motivation.
  • Strong interpersonal skills and ability to work in a multicultural team.

CONTRACT DETAILS

  • Starting ASAP.
  • Position located in Geneva.
  • Full Time & Permanent Contract.
  • EU citizenship or valid Swiss work permit is required.
